Harvey Weinstein hospitalized after New York conviction was overturned

Harvey Weinstein has been hospitalized in New York City, days after the New York Court of Appeals overturned his 2020 rape conviction.

Attorney Arthur Aidala said Saturday that Weinstein had been admitted to Bellevue Hospital in Manhattan for a series of tests. Associated press.

“They examined him and sent him to Bellevue. It looks like he needs a lot of help physically,” Aidala said. ‘He has a lot of problems. He gets all kinds of tests. Health-wise, he’s kind of a train wreck.”

Frank Dwyer, a spokesman for the New York City Department of Correction, said Weinstein remains in custody in Bellevue.

On Thursday, the court ruled in a 4-3 ruling that the judge in the Weinstein trial had shown bias by allowing women to testify about allegations that were not part of the case. The court ordered a new trial.

“We reaffirm that no person charged with illegality should be tried on the basis of evidence of uncharged crimes that serve only to establish the defendant’s propensity for criminal conduct,” Justice Jenny Rivera wrote in the majority opinion of the court. “It is an abuse of judicial discretion to allow untested allegations of nothing more than bad conduct that destroys a suspect’s character but sheds no light on his credibility in relation to the criminal charges brought against him.”

In the 2020 New York case, Weinstein was found guilty of criminal sexual assault in the first degree and rape in the third degree. He served his 23-year sentence at the Mohawk Correctional Facility in Rome, NY

The former movie mogul remains imprisoned as he was also convicted of rape in Los Angeles in 2022 and sentenced to an additional 16 years in prison. However, Weinstein was acquitted at the Los Angeles trial on charges leveled by one of the women who testified in his New York case.
